Welcome to Beauties of the Beasts Animal Rescue, Inc. (“Beauties of the Beasts,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of yumareptiles.com and any pages or services that link to these Terms (the “Site”), including forms, content, features, and donation tools (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who We Are & Contact

Beauties of the Beasts Animal Rescue, Inc. is a 501(c)(3) nonprofit serving Yuma, Arizona and surrounding communities.

2. Eligibility; Accounts; Accuracy

  • You must be at least 13 to use the Site and 18+ to submit surrender, adoption, donation, or volunteer forms.
  • If you create or use any account or submit forms, you must provide accurate, current, and complete information and keep it updated.
  • You are responsible for all activity under your use of the Services.

3. Informational Use Only (No Veterinary/Legal Advice; Assumption of Risk)

Content on the Services is educational and not veterinary, medical, or legal advice. Always consult qualified professionals. You acknowledge that reptile handling and husbandry involve inherent risks; you assume all risk arising from reliance on Site information and any interaction with animals.

4. Not for Emergencies or Wildlife Law Enforcement

The Services are not intended for emergencies. If an animal is in immediate danger or you have a wildlife law issue, contact local authorities or Arizona Game & Fish.

5. Acceptable Use; Prohibited Conduct

You agree not to, and will not assist or enable others to:

  1. Violate any law, regulation, or third-party right.
  2. Upload or transmit malware, exploits, scraping/harvesting tools, or perform DDoS, brute force, or other attacks.
  3. Post or transmit content that is unlawful, misleading, defamatory, obscene, harassing, hateful, or that promotes violence or self-harm.
  4. Engage in illegal wildlife trade, promote acquisition/possession of restricted species, or solicit advice to evade wildlife or public-safety laws.
  5. Misrepresent identity, impersonate others, or submit fraudulent requests or donations.
  6. Use automated means to access the Services except for bona-fide indexing (e.g., standard search engine crawlers).
  7. Copy, distribute, frame, mirror, or create derivative works of the Services except as expressly permitted.
  8. Circumvent security or access controls, or test vulnerabilities without written authorization.
  9. Use the Services to advertise or monetize third-party products, services, or affiliate programs.
  10. Collect, process, or disclose personal data from the Services except as permitted by law and our Privacy Policy.

We may suspend or terminate access for violations, suspected violations, or risk to users, animals, or our organization.

6. Donations; Receipts; Refunds

  • Donations are processed by third-party providers (e.g., Zeffy) over HTTPS. Use may be subject to their terms and privacy policies.
  • We issue email receipts where possible. Donations are tax-deductible to the extent allowed by law.
  • Refunds: Donations are generally non-refundable. If you believe a donation was made in error, email admin@yumareptiles.com within 7 days with your name, amount, date, and reason. We will review in good faith and may require additional verification.

7. User Content; License; Representations

If you submit content (e.g., text, images, forms, documents) (“User Content”):

  • You represent and warrant you own or have rights to submit it and it does not violate law or third-party rights.
  • You grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, modify, adapt, and use User Content to operate our nonprofit (intake, placement, education, outreach, record-keeping, reporting, and compliance).
  • We may remove User Content that violates these Terms or law.

8. Intellectual Property; Limited License

The Services (including text, images, design, logos, and code) are owned by us or our licensors and protected by law. We grant you a limited, revocable, non-transferable, non-exclusive license to access and use the Services for personal, non-commercial, lawful purposes. All other rights are reserved.

9. DMCA / Copyright Policy

If you believe content on the Services infringes your copyright, send a DMCA notice to our agent:

  • Subject: “DMCA Takedown Request”
  • Include: (a) the copyrighted work; (b) the infringing material and its location; (c) your contact info; (d) a statement of good-faith belief; (e) a statement under penalty of perjury that your notice is accurate and you are authorized; (f) your physical or electronic signature.

We may remove content and, if appropriate, terminate repeat infringers.

10. Third-Party Services & Links

The Services may link to or integrate with third-party sites or tools (e.g., donation processors, calendars, social media). We do not control and are not responsible for third-party content, terms, or privacy practices. Your use of third-party services is at your own risk and may be governed by those third parties’ terms and privacy policies.

11. Privacy; Cookies; Electronic Communications

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to receiving electronic communications (e.g., emails about form submissions, receipts, or operational messages). You can opt out of non-essential emails as described in the Privacy Policy.

12. Children’s Privacy

The Services are not directed to children under 13. If we learn we have collected personal information from a child under 13 without verifiable parental consent, we will delete it.

13. Changes; Availability; Beta Features

We may modify the Services and these Terms at any time. We may discontinue or restrict features without notice. Any labeled beta or experimental features are provided as is and may be withdrawn.

14. Disclaimers

To the maximum extent permitted by law, the Services and all content are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not warrant uninterrupted, error-free, or secure operation, or that defects will be corrected.

15. Limitation of Liability

To the maximum extent permitted by law, Beauties of the Beasts and its officers, directors, employees, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; loss of data; or costs of substitute services arising out of or related to the Services or these Terms—even if advised of the possibility. Our aggregate liability for any claim shall not exceed $100 or the amount you paid to use the Services in the 12 months before the claim (whichever is greater). Some jurisdictions do not allow certain limitations; some limits may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless Beauties of the Beasts and its officers, directors, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms or law; or (d) your violation of any third-party right.

17. Governing Law; Venue; Waivers

These Terms are governed by the laws of the State of Arizona, without regard to conflicts principles. Exclusive venue for any action shall be the state or federal courts located in Yuma County, Arizona, and you consent to jurisdiction there.

  • Class Action Waiver: You agree any claims will be brought on an individual basis and not as a class, consolidated, or representative action.
  • Jury Trial Waiver: You and we waive any right to a jury trial.

(If any of the above waivers are unenforceable in your jurisdiction, the remainder still applies to the fullest extent permitted by law.)

18. Termination; Suspension; Survival

We may suspend or terminate your access at any time for any reason, including violations or operational/security risks. Upon termination, your right to use the Services ceases. Sections intended to survive (including 3–7 and 9–21) survive termination.

19. Force Majeure

We are not liable for delays or failure to perform due to events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, utility failures, or government orders.

20. Assignment

You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms in connection with organizational restructuring or by operation of law.

21. Severability; Entire Agreement; Waiver

If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. These Terms constitute the entire agreement between you and us regarding the Services and supersede prior or contemporaneous understandings. Our failure to enforce any provision is not a waiver.
